2. Account Registration and Responsibilities

To access certain features, you must register for an account and provide accurate, current, and complete information. You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activities that occur under your account
• Immediately notifying us of any unauthorized use or security breach

We reserve the right to suspend or terminate your account if we suspect any violation of these Terms or misuse of the Platform.

3. Platform Description

TrainneXpert is an integrated SaaS ecosystem purpose-built to optimize, automate, and centralize training industry operations across multiple stakeholders. The platform currently supports the following core user roles:

TrainneXpert is continuously evolving. Additional modules and user roles—such as facilitators, affiliates, venue partners, and institutional collaborators—may be introduced to expand the ecosystem's value proposition in future development phases.

4. Acceptable Use

You agree not to:

• Use the Platform for any unlawful or fraudulent purpose
• Post or upload any content that is abusive, defamatory, pornographic, or violates any law
• Interfere with the normal operation or security features of the Platform
• Access or scrape data using automated tools without prior authorization
• Impersonate any person or entity, or misrepresent your affiliation

Violations may result in immediate termination and legal action.

5. Payments and Subscriptions

Certain features are subject to paid subscriptions. You agree to:

• Pay all applicable fees as described on the Platform
• Provide valid and current payment information
• Acknowledge that fees are non-refundable unless otherwise stated

TrainneXpert reserves the right to revise pricing, offer trials, and adjust billing cycles with prior notice.

6. Intellectual Property

All content, branding, UI/UX design, software, trademarks, and intellectual property on the Platform are the exclusive property of TrainneXpert or its licensors. Users are granted a limited, non-exclusive, non-transferable license to access and use the Platform for authorized purposes only.

You may not copy, reverse-engineer, resell, or exploit any part of the Platform without written consent.

7. Third-Party Links and Integrations

The Platform may include links or access to third-party websites or tools. We are not responsible for:

• The accuracy or content of those third-party services
• Any loss or damage arising from your use of such services

Your interactions with third-party platforms are governed by their respective terms and policies.

8. Data Privacy

Your use of the Platform is also governed by our Privacy Policy. By using the Platform, you consent to the collection, use, and disclosure of your personal data in accordance with that policy.

9. Suspension and Termination

We may suspend or terminate your access at any time, with or without cause, if:

• You violate these Terms
• You engage in activities that harm the integrity of the platform
• Required by law or regulatory directive

Upon termination:

• Your access will be revoked
• All ongoing services will be cancelled
• Your data may be archived or deleted as per our retention policy

10. Disclaimers and Limitation of Liability

The Platform is provided "as is" and "as available" without warranties of any kind, express or implied.

To the maximum extent permitted by law, TrainneXpert disclaims:

• All warranties including merchantability, fitness for a particular purpose, and non-infringement
• Any liability for loss of data, business interruption, loss of profits, or indirect damages

TrainneXpert's total liability for any claim arising out of or in connection with these Terms shall not exceed the amount paid by you in the past 12 months.

11. Indemnification

You agree to indemnify and hold harmless TrainneXpert, its directors, employees, and affiliates from any claims, losses, liabilities, or expenses arising from:

• Your use or misuse of the Platform
• Any violation of these Terms
• Your infringement of any rights of third parties

12. Governing Law and Dispute Resolution

These Terms shall be governed by and interpreted in accordance with the laws of Malaysia. Any disputes shall be subject to the exclusive jurisdiction of the courts in Kuala Lumpur, Malaysia.

13. Modifications

We may update these Terms periodically. Changes will be posted with an updated "Last Updated" date. Continued use of the Platform after such changes constitutes acceptance.
